The move follows a jury ruling last year thatthe plant’s previous owner, Cinergy Corp., violatesd federal emissions standards after it refurbished the unitws without a permit. Charlotte-basec Duke (NYSE:DUK) bought Cinergyg in April 2006for $9 billion. At the time of last year’s ruling, Duke proposed that units 2, 3 and 5 be retirexd in 2012, when the company’s new integrated gasification combined-cycld plant in Edwardsport, Ind., comes on line. The court’sz order accelerates that timetable bythree years. Shuttingy down units 2, 3 and 5 will removde a combined capacity of265 megawatts. That is 39 perceng of the station’s 677-megawatt power-generating capacity.
The unitas affected by the judge’s decision are more than 50 yearsz old, says Jim Turner, president and chief operating officerof Duke’s franchised electric and gas segment. He says the orde should not impactthe company’s operations this year becauses of changes Duke had already made following the jury’s verdic last year.
